Family Law Defense

Mental verbal or physical abuse unfortunately often become part of difficult family or romantic situations. If you or your family needs to seek a Protection from Abuse order or have been served with an Order as a defendant, Pinnacle Legal Services can assist with the experience of having been involved of hundreds of these types of cases.

Protections from Abuse Actions

You can file for a Protection From Abuse if the person who has committed the abuse is your:
  • Spouse or boyfriend/girlfriend
  • Parent or child
  • Current or former sexual partner
  • Party related by blood

An adult or emancipated minor can file for a protection order. If the abused person is a minor, then a parent, adult household member or guardian ad litem can file on behalf of the child. While these Orders originate in the Civil Courts, violations of temporary and final Orders of the Court can result in Criminal violations for Indirect Criminal Contempt and carry up to six (6) months in jail for each violation. Moreover, due to changes in the law, Protection From Abuse matters have unexpected consequence to the Defendant–namely the prohibition from firearm possession as well as an impact on child custody. For these reasons, Protection from Abuse matters must be handled by an experienced attorney.

Pre-Nuptial of Post Nuptial Agreements

A prenuptial agreement is a contract between people about to wed that spells out how assets will be distributed in the event of divorce or death. Such agreements can vary widely, but typically the content includes provisions for division of property/assets and spousal support in the event of divorce or legal separation.

A postnuptial agreement is much like a prenuptial agreement, however it is a contract that is written after a couple gets married. It is executed to settle the couple’s assets in the event of legal separation or divorce.
Pinnacle Legal Services has the experience to draft and review these very important assets to protect your future.
